Citi/First Data Anti-Gun Policies Stir Controversy, Calls for Boycott

The news that Citi Merchant Services and First Data have refused to process sales for guns and gun accessories has spread like wildfire across the internet, arousing the ire of gun owners around the country. The story broke when the NSSF reported that Citi Merchant Services and First Data terminated the merchant account of CDNN Sports, a large, Texas-based gun retailer. There have been calls for the boycott of Citicorp/Citibank/Citi-Card products, as many gun owners have vowed to close their Citibank accounts or terminate their Citi-affiliated credit cards.

Interestingly, this isn’t the first time Citicorp/Citigroup has faced a boycott threat from gun owners. In 2000, after Citibank imposed a “no firearms” policy on a Nevada gun range, firearms owners nationwide responded with a boycott that caused Citibank to alter its policies.

The Year 2000 Citibank Boycott
As reported by the Second Amendment Foundation (”SAF”), the “Battle began with a February 7, 2000 letter from Citibank to the Nevada Pistol Academy stating that their recently approved account would be closed in ten days ‘due to Citibank not maintaining accounts for businesses that deal in weapons.’ This letter revealed an otherwise secret policy of refusing accounts from lawful, Federally-licensed firearm-related businesses.” In response to a threatened boycott from the SAF and other firearms groups, Citibank, a member of CitiGroup, agreed to drop its policy of refusing accounts of lawful firearms businesses. Citibank agreed to treat small firearms sellers the same as other businesses “using the same standards” according to a Citibank media statement.

Citicorp and First Data Alliance
Fast forward to 2008 — In the current dispute, some folks have wondered whether Citicorp is directly involved in the denial of card processing services to CDNN Sports which sparked the controversy. The answer is yes. Though First Data provides processing solutions, Citi Merchant Services handles the actual banking end of the card processing. First Data explains: “Citi Merchant Services provided by First Data Merchant Services Corporation is a contractual alliance in the U.S. between Citicorp Payment Services, Inc. (CPSI) and First Data Merchant Services Corporation (FDMS). FDMS provides all the systems, technology, processing services and customer support to the alliance. CPSI is the sponsoring card association member and provides the clearing and settlement functions on behalf of the alliance.”

Termination Based on Faulty Legal Interpretation
In terminating CDNN’s merchant services account, and freezing $75,000 of CDNN’s card collections, Citi Merchant Services (”CMS”) and First Data specifically cited the sales of firearms in interstate commerce as the reason. CMS/First Data asserted that interstate firearms sales violate the Gun Control Act and that “shipping across state lines is also banned”. CMS/First Data misconstrue the law, and ignore the fact that any and all firearms sold by CDNN to non-Texas customers must be shipped to licensed FFLs, in full compliance with Federal statute. If you have ever purchased a gun from CDNN you know it will only ship to verified FFL-holders.

Either CMS and First Data are completely ignorant of the law, or they are using a faulty interpretation of Federal law as a pretext to deny services to CDNN. Either way, the actions of CMS and First Data are unjustified. As one internet poster wrote: “Citi Bank [CMS/First Data] has taken the view that THEY are an arm of the BATF.   3. Thank God for the internet in these days of gun grabbing. Today like no-other, gun owning, freedom loving Americans, through firearms related forums and news related sites, can keep each other informed and work together to prevent the loss of our bled and died for freedoms. Does CitiBank have an e-mail address or web site where where we can communicate our displeasure with their policies?

    Editor: That link is very interesting. First, it notes that First Data is involved in 60% of the credit card transactions in the country. I do know that First Data handles transactions for many partners other than Citicorp/Citibank.

    But then the article says that First Data, effective 1/8/2008, issued a policy closing the accounts of gun retailers nationwide who don’t sell via face-to-face transactions. That’s a big jump. I don’t see any facts that support the claim that First Data has gone as far as the merchanttalk article claims… at least yet.

    Lastly, the artcile suggests that other banking/financial institutions may follow First Data’s lead. Again, that seems to be an unsupported assumption… at this time.

  5. Unfortunatly, my 401k at work goes through Citi-Group. I have no choice on whether to boycott this company, since my company has a good match program for my 401k plan. Otherwise I would have no buisiness with them. I already knew I was dealing with anti-gunners since I read they were anti-gun in something the NRA published a while back. I do have to thank Citi-Group for giving me my Loan to build my F-class rifle! In your face Citi-group.

Non face-to-face transactions occur when a cardholder is not present in front of a merchant and includes mail order and online purchases. It is our policy not to service merchants that make non face-to-face sales in a number of industries, including firearms.

    It is not the policy of Citi Merchant Services or First Data to refuse to process transactions from duly licensed merchants that sell firearms in face-to-face transactions at the point of sale.

  8. FYI, the phone number given in the letter has been shut down with a message that if the call is about CDNN then you can email an address given. The employee who sent the letter now has a new work number, so the backlash has begun. I have emailed my Ctit credit card asking them WTF. I’ll see what the reaction is and act accordingly.

  9. So who appointed Citi cards Judge, Jury and Executioner?
    Seems to me if they are now our Social Monitor then they should stop allowing transactions for all Tobacco and Alcohol as well – can’t underage kids buy them? Isn’t that Illegal?
    Why aren’t they applying the “Illegal Purchase” policy across all products? Or is it just politically correct to go after gun owners in an election year?

  11. The problem is that FDC processes 60% or better of the credit card transactions across the country. They also ‘own’ most of the data lines that ATM information is transmitted across (they own the STAR system). USAA uses FDC for all of their credit card transactions. FDC and American Express also have an agreement — see it here:(http://home3.americanexpress.com/corp/pc/2007/fdc.asp)
    First Data is everywhere and is not soley affliated with Citi.
    I hope that they feel major backlash as a result of their decision but I am afraid that this just might be the start of something bigger. I will not give up my right to purchase and own firearms and will not have FDC or Citi telling me what to do or how to do it!!

  14. Don’t we already have a huge federal law enforcement agency dedicated to enforcing firearms laws.

    Is FDC/Citi looking to be a self appointed arm of the ATF?

    I don’t know about you but I get 4 or 5 Citi credit card offers a month. I will begin using their pre-paid envelopes to return an articulately written message detailing exactly why I will be taking my business elsewhere. Thats 60 messges a year from just me. If we could get a couple hundred or maybe a couple thousand friend and family members to do the same thats a big statement.

    The best part is using their unsolicited, pre-paid envelopes to make them pay for it:)

    This of course applies to Texas residents also if the firearm is shipped.

  16. Why don’t you idiots stop doing business with car dealers?  Their productkills more people than guns ever did.I Will be canceling my Citi Master Card and changing to someone who wantsto do business with a person in the gun business.

  17. Citi is not the only un-friendly credit company out there. GEMoney Bank has withdrawn credit to a local company strictly on the basis it is being used for guns and ammo. Maybe add them to the list of boycott list, I think it will be long.
